These Terms of Business outline the terms and conditions under which Fusrol provides its services as a custodian of renters' security deposits and as an arbitration service at the end of a lease. By using our services, you agree to comply with and be bound by these terms. Please read them carefully.

  • 1. Services Provided

    Fusrol offers the following services: Security Deposit Custodianship:

    Fusrol acts as a neutral third party to hold and safeguard renters' security deposits during the lease term.

    Funds are held in a secure, interest-bearing account, in compliance with applicable state and federal laws.

    Arbitration Service:

    At the end of the lease term, Fusrol provides impartial arbitration services to resolve disputes between tenants and landlords regarding the return or forfeiture of the security deposit.

    Arbitration decisions are binding and based on the terms of the lease agreement, applicable laws, and evidence provided by both parties.

  • 2. Eligibility

    Fusrol’s services are available to landlords and tenants within the United States who agree to these Terms of Business.

    Both parties must provide accurate and complete information during the onboarding process.

  • 3. Security Deposit Handling

    Deposit Submission:

    Landlords or tenants must submit the security deposit to Fusrol within the timeframe specified in the lease agreement.

    Holding Period:

    The deposit will be held in a secure account until the lease ends or a dispute is resolved.

    Interest:

    Any interest accrued on the deposit will be distributed as required by applicable state laws or as agreed upon by both parties.

  • 4. Dispute Resolution and Arbitration

    Initiation of Arbitration:

    Either party may request arbitration through Fusrol within [X] days of the lease termination.

    Evidence Submission:

    Both parties must submit all relevant documentation, including the lease agreement, move-in/move-out inspection reports, photographs, and any other evidence supporting their claim.

    Arbitration Process:

    Fusrol will appoint a neutral arbitrator to review the case. The arbitrator’s decision will be based on the lease terms, applicable laws, and the evidence provided. The decision is final and binding on both parties.

    Fees:

    A non-refundable arbitration fee may apply, as outlined in the fee schedule provided at the time of service.

  • 5. Fees and Charges

    Fusrol charges a service fee for its custodianship and arbitration services. Fees will be clearly communicated during the onboarding process.

    Fees may include:

    1. A one-time setup fee for custodianship.
    2. An annual maintenance fee for holding the deposit.
    3. An arbitration fee, if applicable.

  • 6. Liability and Disclaimers

    Fusrol is not liable for any disputes arising between tenants and landlords, except as related to its role as a custodian and arbitrator.

    Fusrol is not responsible for any losses or damages resulting from:
    1. Fraudulent or inaccurate information provided by either party.
    2. Disputes unrelated to the security deposit.
    3. Acts of God, natural disasters, or other unforeseeable events.

    Fusrol’s liability is limited to the amount of the security deposit held in its custody.

  • 7. Termination of Services

    Fusrol reserves the right to terminate its services if either party violates these Terms of Business or engages in fraudulent or unlawful activities.

    In the event of termination, the security deposit will be returned in accordance with applicable laws and the lease agreement.

  • 8. Governing Law

    These Terms of Business are governed by the laws of the state in which Fusrol is registered.

    Any legal disputes related to these terms will be resolved in the courts of that state.

    Fusrol reserves the right to update or modify these Terms of Business at any time.

    Users will be notified of any changes, and continued use of Fusrol’s services constitutes acceptance of the updated terms.
